You agree to provide accurate, current information and to keep it updated (for example, ensure your contact details and payment information are correct). You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account. If you suspect unauthorized use of your account, notify us immediately. We are not liable for any loss or damage arising from your failure to safeguard your account.

4. Rules of Conduct

When using our website or services, you agree to:  

- Use the platform only for its intended purpose (e.g., genuine rental inquiries, bookings, or property management tasks).  

- Not engage in any illegal, fraudulent, or harmful activity. This includes refraining from posting false or misleading information, harassing others, or attempting to breach the security of the site.  

- Respect the rights of others. Do not infringe or violate others’ privacy, intellectual property, or other rights. For instance, you shall not upload content to our platform that you do not have permission to use.  

- Not use our site to transmit spam, unsolicited messages, or collect personal information about others without consent.  

We reserve the right to suspend or terminate your access if you violate these rules or engage in behavior that we deem harmful to the platform or other users.

5. Mobile Messaging & AI Voice Terms

By providing your mobile phone number to Killington Mountain Homes, Inc. and consenting to receive communications, you agree to the following terms:

Consent to Communications (SMS & AI Voice): You grant Killington Mountain Homes, Inc. explicit permission to contact you via SMS/text messages, prerecorded voice messages, and calls using artificial or AI-generated voice technology at the number provided. These communications may be generated by an automated system and may include responses to your inquiries, delivery of requested resources, or marketing content. You acknowledge and agree that all calls to and from Killington Mountain Homes, Inc. may be monitored and recorded for quality assurance purposes. (Standard message & data rates apply. Consent is not a condition of purchase.)

Frequency: Message frequency may vary based on your interactions. For example, you may receive a series of messages delivering your requested content, followed by occasional marketing updates.

Cost: Killington Mountain Homes, Inc. does not charge you for sending or receiving texts, but message and data rates may apply as per your mobile carrier plan. You are responsible for any such charges.

Opt-Out: You can cancel the SMS service at any time. To stop receiving texts, simply reply with the word “STOP” to any message we send. When we receive a STOP request, we will send a confirmation SMS to let you know you’ve been unsubscribed, and after that you will no longer receive SMS from us.

No Liability for Delivery: We strive to deliver messages promptly, but carriers (e.g., AT&T, Verizon, etc.) are not liable for delayed or undelivered messages. We cannot guarantee SMS delivery as it may be subject to your mobile provider’s coverage and systems.

Data Privacy: We handle your personal data, including your phone number, in accordance with our Privacy Policy (see below). We will not share your mobile number or SMS consent with unauthorized third parties, and it is used solely to provide our services to you.

Notice and Cure Period: If you wish to stop receiving text messages, you agree to reply with the word 'STOP'. You acknowledge that this is the exclusive method for opting out. You further agree to provide us with a 15-day cure period to process your request before asserting any claim related to unwanted messages. You contractually waive any right to statutory damages for messages sent prior to the expiration of this 15-day cure period.

6. Intellectual Property  

All content and materials on , including text, graphics, logos, button icons, images, audio clips, and software, are the property of Killington Mountain Homes, Inc. or its content suppliers and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from our content without express written permission from us. You are permitted to temporarily download one copy of the materials (e.g., property listings) on our website for personal, non-commercial transitory viewing only. This is a grant of license, not a transfer of title. You must not remove any proprietary notices from materials downloaded or printed from our site.

7. Disclaimers  

Use at Your Own Risk: Our services are provided on an “as is” and “as available” basis. While we strive for accuracy, Killington Mountain Homes, Inc. makes no warranties about the reliability or results of our services.

AI & Automated Output: Some of our services (including pricing tools and guest communication agents) utilize Artificial Intelligence. While we strive for precision, AI systems can occasionally produce incorrect or "hallucinated" information. You agree that Killington Mountain Homes, Inc. is not liable for errors in pricing, guest responses, or operational advice generated by AI. It is your responsibility to verify critical information.

Property Listings: We are not responsible for the accuracy of listings or property conditions. We act only as an intermediary platform. Actual rental agreements are between the property owner and the guest.

No Income Guarantee: Any guidance on rental pricing, revenue management, or investment projections is for informational purposes only. We do not guarantee specific occupancy rates, rental income, or investment returns. Past performance is not indicative of future results.

8. Limitation of Liability  

To the maximum extent permitted by law, Killington Mountain Homes, Inc. and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. In no event will our total liability to you for all claims arising out of or relating to these Terms or your use of the services exceed the amount you paid to us (if any) in the past twelve months. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by law.

9. Indemnification  

You agree to indemnify and hold harmless Killington Mountain Homes, Inc. and its partners, employees, and agents from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms, your misuse of the services, or your violation of any law or the rights of a third party. 

10. Binding Arbitration and Class Action Waiver

Any dispute or claim arising from these Terms or our communications (including SMS and calls) shall be governed by the laws of the State of Vermont, USA.

A. Individual Arbitration: You and Killington Mountain Homes, Inc. agree that any legal dispute shall be settled by binding, individual arbitration in Rutland County, Vermont, rather than in court. This arbitration shall be conducted on an individual basis, and not as a class, consolidated, or representative action.

B. Class Action Waiver: YOU AND Killington Mountain Homes, Inc. AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. Other rights that you would have if you went to court may also be unavailable or may be limited in arbitration.

C. Jurisdiction: In the event that any dispute is found not to be subject to arbitration, you consent to the exclusive jurisdiction of the state or federal courts located in Rutland County, Vermont.
